Terms of Service

These Terms of Service ("Terms") govern your use of PropertySiteCheck ("we," "us," or "our") and the environmental screening reports, related services, and website at propertysitecheck.com (collectively, the "Service"). By using the Service, you agree to these Terms.

1. What PropertySiteCheck Is

PropertySiteCheck aggregates publicly available environmental data from federal, state, and regional agencies (including the U.S. Environmental Protection Agency, FEMA, USDA, USFWS, USGS, and the Michigan Department of Environment, Great Lakes & Energy) and presents it as a screening report for a given property address. The Service is a research tool for environmental due diligence; it is not a substitute for a Phase I Environmental Site Assessment performed by a qualified environmental professional in accordance with ASTM E1527-21 or the equivalent.

2. Accuracy of Data

We rely on third-party government databases that may be incomplete, out-of-date, or contain errors outside our control. PropertySiteCheck reports reflect the data available at the time of generation and the accuracy of the underlying sources. We make no warranty that the data is current, complete, or fit for any specific purpose, including transactional, regulatory, or insurance decisions. You assume all risk associated with relying on a PropertySiteCheck report.

3. Geographic Coverage

At launch, PropertySiteCheck only screens properties located within the State of Michigan, USA. Reports for addresses outside Michigan will be rejected at the screening step. We may expand coverage in the future without notice.

4. Accounts and Access

You may use the Service anonymously to purchase a single report. To purchase a bundle or subscription, you must register an account using a valid email address and choose a password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

We reserve the right to suspend or terminate any account that abuses the Service, including automated scraping, attempts to bypass rate limits, or use of credentials to share access among multiple parties.

5. Pricing and Plans

Current pricing is published on our pricing page:

  • Single Report — one-time payment per property screening.
  • 5-Pack Bundle — one-time payment for five report credits that do not expire.
  • Pro Monthly — recurring monthly subscription with a defined per-month report allowance; unused reports roll over indefinitely and never expire while the subscription is active.
  • Pro Annual — recurring annual subscription billed in advance.

We may change pricing at any time. Existing subscriptions remain at the price you signed up at until your next renewal; changes will be communicated by email at least 30 days before they take effect.

6. Payment and Billing

Payments are processed by Stripe, Inc. We do not store credit card information on our servers. By providing payment information, you authorize PropertySiteCheck and Stripe to charge the amount shown at checkout, plus any applicable taxes, to your payment method.

Subscriptions automatically renew at the end of each billing cycle until canceled. You can cancel at any time from your account dashboard via the Stripe Customer Portal. Cancellation stops future renewals; it does not refund the current billing period (see Refund Policy below).

8. Intellectual Property

The PropertySiteCheck website, brand, design, and software are our property. The underlying government data is in the public domain and we make no claim to it. You may use generated reports for your own personal or business decisions, including sharing them with attorneys, agents, lenders, or consultants involved in a specific transaction. You may not redistribute, resell, scrape, or republish reports outside that scope without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, PropertySiteCheck's total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost transactions, or remediation costs, even if we have been advised of the possibility of such damages.

Environmental screening reports are research aids. You are solely responsible for any decision to enter into, decline, modify, or finance a property transaction. PropertySiteCheck is not your environmental consultant, attorney, or financial advisor.

10. Indemnification

You agree to indemnify and hold PropertySiteCheck harmless from claims by third parties arising from your use of the Service, your violation of these Terms, or your decisions made on the basis of a report.

11. Service Availability

We aim for high availability but make no uptime guarantee. The Service depends on third-party government APIs and infrastructure providers that may be unavailable, slow, or returning outdated data at any given moment. We are not liable for downtime or degraded performance caused by upstream providers.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email to registered users at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Michigan, and you consent to the personal jurisdiction of those courts.
